Bangladesh Legal Aid Services and Trust (BLAST)
BLAST filed a writ petition impugning specific provisions of the Local Government (Gram Parishad) Act, 1997, in particular sections 2(e), 5(3), 8(1), 10, 11 and 16, as being violative of Articles 9, 11, 59 and 60 of the Constitution. The Act provided for a Gram Parishad (Village Council) in every ward, to be constituted under section 5 of the Act, consisting of nine male members, three female members and the elected member of the Union Parishad of the respective ward as the Chairman. The others would be selected by a body designated by the government from men and women enrolled in the electoral roll of the respective wards.
The High Court issued a Rule Nisi on 24.11.1997 to show cause as to why the specific provisions of the Gram Parishad Act should not be declared to be unconstitutional and void.
(The Parliament repealed the law in 2003.)
